Terms of Service

1. Acceptance of these terms

By creating an account, playing as a guest, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old (or older where your local law requires — for example, 15 in France) to use the Service. By using it, you represent that you meet this requirement and that you are able to enter into a binding agreement.

3. Your account

You can play as a guest, or create an account with an email and password or by using Google or Apple sign-in. You are responsible for keeping your credentials secure and for all activity under your account. Please provide accurate information and notify us promptly of any unauthorized use. You may delete your account at any time via the Support page.

4. Acceptable use

When using the Service, you agree not to:

• Cheat, or use bots, scripts, automation, or external assistance to gain an unfair advantage in live play against other people.
• Harass, threaten, impersonate, or abuse other players, including through usernames, avatars, or in-game reactions.
• Upload or share content that is illegal, hateful, obscene, or infringes anyone’s rights.
• Attempt to disrupt, overload, hack, or reverse-engineer the Service, or access it other than through the interfaces we provide.
• Scrape, harvest, or collect data about other users, or use the Service to send spam.
• Create multiple accounts to manipulate ratings, leaderboards, or matchmaking.

We may remove content and suspend or terminate accounts that violate these rules.

5. Fair play & anti-cheat

Backgammoner is built for fair, competitive play. We may use automated and manual methods to detect cheating, collusion, rating manipulation, and other abuse, and to take action — including adjusting ratings, restricting features, or terminating accounts. Practice and single-player matches are played against our own bots; using third-party move assistance against human opponents is prohibited.

6. Your content

You may provide content such as a username, display name, avatar image, and in-game reactions (“Your Content”). You keep ownership of Your Content, and you grant us a non-exclusive, worldwide, royalty-free license to host, display, and use it as needed to operate the Service (for example, showing your avatar to opponents). You are responsible for Your Content and confirm you have the right to share it. We may remove content that violates these Terms.

7. Purchases & paid features

The core game is free to play. We may offer optional paid features or subscriptions in the future. If we do, the price, billing terms, and any free-trial or renewal details will be shown to you before you buy, and purchases made through an app store (such as Apple’s App Store) are also subject to that store’s payment terms and refund policies. Any paid features are designed to enhance your experience — such as insight into your own past games — and never to give a paying player an advantage in live play.

8. Intellectual property

The Service — including its software, design, board and interface graphics, text, and the Backgammoner name and logo — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as allowed by these Terms or applicable law. (Backgammon itself is a public-domain game; these rights cover our specific implementation, not the game’s rules.)

9. Apple App Store terms

If you download our iOS app from the Apple App Store, the following also applies:

• These Terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
• Your license to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• Apple is not responsible for any product warranties or for addressing any claims relating to the app (including product-liability, legal-compliance, or intellectual-property claims); those are our responsibility to the extent required by law.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that ratings and matchmaking will be free of imperfections. Nothing in these Terms excludes rights you have under mandatory consumer law.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

13. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective” date above and, where appropriate, notify you in the app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of France, without regard to conflict-of-laws rules. Any dispute relating to the Service or these Terms will be subject to the jurisdiction of the competent French courts, unless mandatory law in your country of residence gives you the right to bring proceedings elsewhere. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
